Court of Cassation: Conditions for poverty alimony do not arise if incomes are equivalent

The 2nd Civil Chamber of the Court of Cassation (Yargıtay) upheld a divorce ruling by the Bakırköy 13th Family Court, but overturned the award of poverty alimony to the woman, noted to be retired with regular income, on the grounds that the parties' incomes were comparable.

Court of Cassation overturns poverty alimony ruling for spouse with comparable income

The Court of Cassation's 2nd Civil Chamber found unlawful the ruling by the Bakırköy 13th Family Court that awarded poverty alimony to a retired woman with a regular income whose income level was close to her spouse's; the divorce ruling itself was upheld.
