The Court of Cassation's 2nd Civil Chamber found unlawful the ruling by the Bakırköy 13th Family Court that awarded poverty alimony to a retired woman with a regular income whose income level was close to her spouse's; the divorce ruling itself was upheld.
In its ruling, the chamber noted that the woman was retired, had regular and fixed income, and that their incomes were close to each other. On these grounds, it stated that awarding alimony was contrary to law.
