The Turkish Court of Cassation (Yargıtay) ruled that a worker who did not receive annual leave pay in advance when taking leave may rightfully terminate the employment contract and qualify for severance pay.
The ruling was issued to set a precedent after two labour courts in the same city issued different rulings in similar cases. The high court also stated that granting a worker more leave than earned does not remove the obligation to pay leave wages in advance.
