The Turkish Court of Cassation (Yargıtay) resolved the dispute over whether a worker's earlier service at the same workplace counts in the compensation paid by an employer who fails to reinstate the worker after a reinstatement order.

The decision was taken in file No. 2026/1 Main, 2026/823 Decision, dated 4 February 2026. The dispute had arisen from differing rulings by civil chambers of the Adana regional court of appeal on workers who kept working at the same workplace after retiring or leaving.
