The 4th Criminal Chamber of the Court of Cassation (Yargıtay) ruled that whether an insult on social media counts as public must be decided by examining both whether the account was open to everyone and how many people the post could reach.
The ruling was given in the case of a defendant sentenced to 1 year, 5 months and 15 days in prison for insulting his former fiancee on social media in Ödemiş district of Izmir. The chamber said the local court had not sufficiently examined the element of publicity.
